1. Who these terms are between

These terms govern the 1-UP Club membership (the "Membership") offered by:

We do not provide a phone number for customer enquiries. Every membership request, question or complaint should reach us by email.

The Membership is a separate, paid subscription contract between you and Retrobroker. These terms sit alongside our Terms and Conditions, Privacy Policy and Shipping and Returns Policy, which continue to apply to everything you buy from us. Where a membership matter is covered both here and in our general Terms and Conditions, this document takes precedence.

2. Eligibility

  • You must be at least 18 years old and have a registered Retrobroker account.
  • One active Membership per customer account.
  • The Membership is personal and non-transferable. Its benefits apply to your own purchases only. You may not share, resell or otherwise make your benefits available to anyone else, and you may not use them for resale or business-scale buying.
  • The Membership is available only where we are able to bill you in a currency we support (see section 4.3).

3. Joining

  1. Choose a billing interval — monthly or annual — on the membership page.
  2. Enter your card details and tick the consent box confirming the price, the interval and the automatic renewal.
  3. Your bank may ask you to authenticate the payment (Strong Customer Authentication). Until that is completed, your membership shows as "payment not completed" and no benefits are active.

The membership contract is formed when your first payment succeeds and your membership is shown as active on your account page.

Your card details never reach our servers. All payments are processed by Stripe, our payment provider, and by making a purchase you also agree to Stripe's terms. We receive only the result of the payment and a reference to the stored card.

4. Fees, renewal and currency

4.1 The price

You pay the price displayed on the membership page at the moment you join, in the currency quoted on that screen, including any applicable VAT. Membership fees are for the Membership itself and are separate from the price of any item you buy.

4.2 Automatic renewal

The Membership renews automatically at the same interval until you cancel it. On each renewal date we charge the card on file. Your next payment date and your current billing interval are always shown on your membership page.

4.3 Your billing currency is fixed

Our payment provider fixes the currency of a subscription at its first invoice. That currency cannot be changed for the lifetime of the Membership, even if you later shop from another country or in another currency. If a plan or a billing interval is not priced in your billing currency, it is not available to you; we will say so rather than quoting you a price we cannot charge.

Prices quoted on the public membership page reflect the region you are browsing from and may differ from what an existing member is billed. The amount shown on your own membership page is the authoritative one.

4.4 Changing your billing interval

You may switch between monthly and annual billing at any time. Your next invoice is adjusted for the time remaining in the period you have already paid for, as calculated by our payment provider. The new billing date is shown on your membership page once the change is made.

4.5 Failed payments

If a renewal payment fails, we will retry it. Your benefits continue during the grace period shown on your membership page, and we will ask you to update your card. If payment has not succeeded by the end of that grace period, your benefits stop and the Membership may be cancelled.

4.6 Price changes

We may change the membership fee. We will tell you before a new price applies, and it will take effect no earlier than your next renewal. If you do not accept the new price, you may cancel before that renewal (section 5.1).

5. Cancellation, resumption and your right of withdrawal

5.1 Cancelling

You may cancel your Membership at any time from your account page. Cancellation is never immediate. It takes effect at the end of the period you have already paid for: you keep every benefit until that date, and the fee for the current period is not refunded on a pro-rata basis. The end date is shown on your membership page.

5.2 Changing your mind about a cancellation

Up until the end of the current period, you can resume a cancelled Membership from your account page. It then continues as normal with no gap and no new joining step.

5.3 Your statutory right of withdrawal

If you are a consumer in the European Union, you have 14 days from the day the Membership contract is concluded to withdraw from it without giving a reason. To withdraw, send us an unambiguous statement by email to [email protected]. You may use the model withdrawal form, but you do not have to.

Because your Membership becomes active — and member pricing and the other benefits apply — as soon as your first payment succeeds, you are asking us to begin performance during the withdrawal period. Where you then withdraw, you owe an amount proportionate to the part of the period already served, and we may deduct the value of benefits you have already drawn on, for example a member discount already applied to an order, shipping we waived, credit you have spent, or a repair or service already provided at a member rate.

We refund what is due within 14 days of receiving your withdrawal, using the same payment method you paid with.

5.4 When we may end a Membership

We may suspend or terminate a Membership for serious or repeated breach of these terms, for abuse of member benefits, or for fraud — including the illegitimate credit card claims described in our Terms and Conditions. Where we end a Membership for a reason other than your breach, we refund the unused part of the period you have paid for.

6. What the Membership includes

The benefits listed on the membership page are the current and authoritative list. That page reflects what the Membership includes today, and it prevails over any description elsewhere, including examples in this document. Benefits usually comprise some combination of member pricing, an extended guarantee, early access to new arrivals, item holds, a member free-shipping threshold, a trade-in bonus, a repair discount, store credit and included services.

6.1 Member pricing

Member prices apply automatically while you are signed in and your Membership is active. They apply to the product categories shown on the membership page, not necessarily to the whole catalogue. How member pricing combines with a sale price or a discount code is reflected in the total shown at checkout — the price you see at checkout is the price you pay.

6.2 Early access

Some new arrivals are shown to members for a period before they are listed publicly. Items in early access are not publicly listed during that window, so a link shared with a non-member will not open until the window ends. Early access is a viewing window, not a reservation: nothing is held for you unless you place a hold or complete a purchase, and we do not guarantee that any item is still available when you get to it.

6.3 Holds

A hold places a real reservation on stock — the item is genuinely taken off sale for the duration of the hold. The number of holds you may run at once and how long each lasts are shown on your holds page. A hold expires automatically at the end of its window and the item returns to sale.

A hold is not a purchase and does not create a contract of sale. Nothing is yours until you have checked out and paid.

Releasing a hold early never counts against you. Repeatedly letting holds expire without buying does: we may suspend your ability to place holds for a period, and we will show you the date on which the ability returns. The rest of your benefits are unaffected by such a suspension.

6.4 Free shipping for members

Where the Membership includes a lower free-shipping threshold, it applies to the currency of your cart. If we have not set a member threshold in that currency, the ordinary public threshold applies. We never convert a threshold from one currency into another.

6.5 Store credit, trade-in bonus and repair discounts

Any store credit granted as part of the Membership is tied to a single currency and can only be spent against orders in that currency. It has no cash value, cannot be transferred or paid out, and lapses when the account it belongs to is closed. Trade-in bonuses and repair discounts apply on the terms quoted at the time of the individual trade-in or repair.

6.6 Changes to the benefits

We may add, change or withdraw benefits. If we materially reduce what the Membership includes, we will tell you beforehand and the change will take effect no earlier than your next renewal, so that you can cancel first if you would rather not continue. The availability, price and stock of any individual item are never guaranteed by the Membership.

7. Guarantees

7.1 Your statutory rights come first

Every item you buy from us carries the legal guarantee of conformity under Polish and EU consumer law, whether or not you are a member. Nothing in the Membership limits, replaces or shortens that right.

7.2 The membership extension

The Membership's extended guarantee is a commercial guarantee, granted voluntarily by us in addition to your statutory rights. It runs for the additional period shown on the membership page, beyond the end of the legal guarantee.

Guarantees are created automatically when you place an eligible order while your Membership is active — you never need to register one. Each is issued with a certificate number, the end date of the legal guarantee and the end date of the commercial extension, both shown in your account and downloadable as a PDF certificate.

7.3 Guarantees outlive the Membership

A guarantee already granted stays valid for its full term even if you later cancel your Membership. Your certificates remain available in your account. Cancelling stops new guarantees from being granted; it does not shorten the ones you have.

7.4 What the extension covers

The extension covers defects in materials or workmanship arising in normal use. In line with our Terms and Conditions, it does not cover damage caused by misuse, accident, liquid, modification or unauthorised repair, nor normal cosmetic wear, scratches on game discs or consumable parts such as batteries.

To make a claim, email [email protected] with your certificate number and a description of the issue. We assess the validity of claims and may repair, replace or refund the item at our discretion. A guarantee may be recorded as void where the item has been resold, opened or repaired by an unauthorised party, or where a claim is found to be fraudulent.

8. The savings figure

The savings total shown in your account records what membership actually saved you on individual orders, at the moment each order was placed. It is a record of events, not an estimate or a projection, and it is kept separately for each currency you have shopped in — figures in different currencies are never added together. Past savings do not predict future savings and are not a promise of any level of benefit.

9. Your personal data

Our Privacy Policy explains how we collect, use and protect your personal information. In connection with the Membership we also process your subscription status, billing dates and the records behind your guarantees, holds and savings, for as long as we need them for the contract and for our tax and accounting obligations. Payments are processed by Stripe, which handles your card data as an independent provider under its own terms.

10. Changes to these terms

We may update these terms. Where a change materially affects your rights or obligations, we will tell you before it takes effect and it will apply no earlier than your next renewal. If you keep your Membership after the effective date, you accept the updated terms; if you do not accept them, cancel before that date under section 5.1.

11. Complaints and applicable law

Please send complaints to [email protected]. We reply to consumer complaints within 14 days of receiving them.

These terms are governed by Polish law. If you are a consumer resident elsewhere in the European Union, this does not deprive you of the protection of any mandatory provisions of the law of your country of residence.

Consumers may also seek out-of-court resolution of a dispute. In Poland this is available through the Trade Inspection Authority (Wojewódzkie Inspektoraty Inspekcji Handlowej) and through the district or municipal consumer ombudsman (powiatowy lub miejski rzecznik konsumentów), free of charge.
