1. Who you are dealing with

We do not operate a customer phone line. Every order question, complaint or withdrawal notice should reach us by email, which gives both of us a written record.
2. What these terms cover
These terms govern your use of our online store and every purchase you make through it. By placing an order you accept them. If you do not accept them, please do not order from us.
Two related documents sit alongside these terms and apply to you as well: our Privacy Policy, which explains what we do with your personal data, and our Shipping and Returns Policy, which sets out delivery, withdrawal and return mechanics in detail. If you are a 1-UP Club member, the 1-UP Club Membership Terms also apply, and on membership matters they take precedence over this document.
3. Who may buy
You must be at least 18 years old and able to enter into a binding contract. By ordering, you confirm that you are.
We sell to consumers and to businesses. Where a right below is described as belonging to a consumer — in particular the right of withdrawal in section 8 — it applies only if you are buying as a consumer, meaning for purposes outside your trade, business or profession.
4. What we sell
We sell second-hand retro games, consoles, accessories and related items, and occasionally new items where the listing says so.
Used goods are not perfect, and their condition is part of what you are buying:
- Each listing describes the item's condition and shows photographs of the specific item, or of an item representative of the batch where the listing says so.
- Cosmetic wear — scuffs, scratches on shells and cases, faded labels, yellowing plastic, wear on discs and cartridges — is normal for hardware and media that is decades old and is not a defect.
- Unless a listing explicitly says otherwise, assume that original packaging, manuals, inserts, cables and controllers are not included.
- Save data on cartridges and memory cards is not guaranteed and may be erased.
- Region locking is a property of the hardware and the media. Check compatibility with your own equipment before ordering; we describe the region where we can identify it.
If a listing and this document ever conflict on what a specific item includes, the listing wins.
5. Prices and currency
Prices are shown in the currency you are browsing in and include VAT where VAT applies. We can bill in AUD, CAD, CHF, CZK, DKK, EUR, GBP, HUF, NOK, PLN, SEK and USD.
Delivery costs are not included in the item price. They are calculated from the destination and the weight of the parcel and are shown in full before you confirm and pay.
We may change prices at any time, but a change never affects an order we have already accepted. Availability can change while you are browsing, because much of what we sell exists in a single unit.
Very occasionally an item is listed at an obviously incorrect price. Where the error is clear and you could reasonably have recognised it as an error, we may cancel the order and refund you in full rather than deliver at that price.
5.1 Customs and import charges
For deliveries outside the European Union, customs duties, import VAT and clearance fees may fall due on arrival. These are set by the destination country, are not included in what you pay us, and are your responsibility as the importer.
6. How an order becomes a contract
- You place the item in your basket and complete checkout.
- We send an acknowledgement email. This confirms that we received the order — it is not yet our acceptance of it.
- The contract is formed when we confirm dispatch, or when we deliver, whichever happens first.
Between those steps we may decline an order — for example if the item turns out to be damaged or already sold, if we cannot verify your details, if delivery to your address is not something we can arrange, or if we reasonably suspect fraud or resale abuse. If we decline, we refund any payment in full and explain why.
7. Payment
All payments are processed by Stripe, our payment provider. Your card details are entered on Stripe's systems and never reach our servers; we receive only the result of the payment and a reference to the stored card. By paying you also accept Stripe's terms.
Your bank may require you to authenticate the payment (Strong Customer Authentication). Until that is complete, the payment has not succeeded and the order does not progress.
8. Your right to withdraw
If you are a consumer in the European Union, you may withdraw from a distance purchase within 14 days of the day you — or someone you nominate — take physical possession of the goods. You do not have to give a reason.
To withdraw, send an unambiguous statement by email to [email protected] before the 14 days are up. You may use the model withdrawal form, but you do not have to. Our Shipping and Returns Policy sets out the full procedure, the return address and how refunds are calculated, and forms part of these terms.
Two points that consumer law requires us to state plainly:
- You pay the cost of returning the goods unless we agree otherwise in writing or the return is because the item was faulty or not as described.
- You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning — roughly, what you could have done in a shop.
The right of withdrawal does not apply to sealed audio or video recordings, or sealed computer software, if you have unsealed them after delivery. It also does not apply to items made to your specification.
9. Guarantees on what you buy
9.1 Your statutory rights come first
Everything you buy from us carries the legal guarantee of conformity under Polish and EU consumer law. If an item is not as described, not of the quality you can reasonably expect, or does not work as it should, you are entitled to have it brought into conformity — by repair or replacement — or, where that is not possible or proportionate, to a price reduction or to withdraw from the contract and be refunded.
Polish law allows a trader and a consumer to agree a shorter liability period for second-hand goods, provided it is not less than one year from delivery. We apply a period of one year from delivery for used items, and the full statutory period for any item sold as new.
Nothing in these terms limits, replaces or shortens your statutory rights, and nothing below should be read as trying to.
9.2 Our commercial guarantee
In addition to your statutory rights, we voluntarily give a 30-day commercial guarantee from the date of delivery on used consoles and games. It covers defects in materials or workmanship appearing in normal use, and under it we will repair, replace or refund the item at our discretion.
It does not cover damage from misuse, accident, liquid, modification or unauthorised repair, nor normal cosmetic wear, scratches on game discs, or consumable parts such as batteries.
This commercial guarantee runs alongside your statutory rights — it never replaces them, and choosing not to use it costs you nothing.

9.3 Making a claim
Email [email protected] with your order number and a description of the problem, with photographs or video where they help. We answer consumer complaints within 14 days of receiving them. We assess each claim on its merits and may ask you to return the item before we resolve it.
10. Chargebacks and misuse of payment claims
If something has gone wrong with an order, please contact us first — it is almost always faster than a bank dispute, and we would rather fix the problem than argue about it.
Where a payment claim is raised against us that turns out to be unfounded, we reserve the right to recover from the customer the costs we actually and reasonably incur as a result, to the extent that applicable law permits. We do not charge a fixed penalty, and this paragraph never limits a genuine right to dispute a payment.
We may also suspend or close an account, and decline future orders, where we find fraud, repeated unfounded claims, or systematic abuse of our returns process.
11. Intellectual property
The content of this website — our text, photographs, layout and logos — belongs to us or to our licensors and is protected by intellectual property law. You may not copy, redistribute or reuse it commercially without our written permission.
Game titles, console names, box art and trade marks belong to their respective owners. We use them only to identify and describe the second-hand items we offer for sale.
12. Our liability
We are liable to you for foreseeable loss and damage that we cause by breaking this contract or by failing to use reasonable care and skill.
We do not exclude or limit our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, and under the statutory rights described in section 9.
We are not liable for loss that was not foreseeable, for loss arising from your own failure to follow reasonable instructions, or — if you are buying as a business — for loss of profit, loss of business or loss of data. Nothing here affects a consumer's statutory rights.
Retro hardware is old. Please use appropriate power supplies, cables and accessories for your equipment and region; we are not liable for damage caused by unsuitable third-party equipment.
13. Your personal data
Our Privacy Policy explains what personal data we collect, why we collect it and how long we keep it, and sets out your rights over it. Our Data Deletion Policy explains how to ask us to erase your data.
14. Changes to these terms
We may update these terms. The version in force for your order is the one published when you placed it, and we keep the date of the latest revision at the top of this page. Where a change materially affects your rights, we will make that clear rather than quietly editing the text.
15. Complaints, applicable law and disputes
Send complaints to [email protected]. We reply to consumer complaints within 14 days.
These terms are governed by Polish law. If you are a consumer resident elsewhere in the European Union, that choice does not deprive you of the protection of any mandatory provisions of the law of your own country of residence.
Consumers may also seek out-of-court resolution of a dispute. In Poland this is available through the Trade Inspection Authority (Wojewódzkie Inspektoraty Inspekcji Handlowej) and through the district or municipal consumer ombudsman (powiatowy lub miejski rzecznik konsumentów), free of charge.
