Data Deletion Policy
Data Deletion Policy
1. Right to Erasure (Right to Be Forgotten)
The right to get your data deleted, also known as the ‘right to erasure’, allows you to request the deletion of personal data held by an organization. You can exercise this right under the following circumstances:
- Data No Longer Needed: If the organization no longer requires your data for its original purpose (e.g., after canceling a gym membership, the gym no longer needs your personal details).
- Withdrawn Consent: If you initially consented to the use of your data but have now withdrawn that consent.
- Objection: If you object to the use of your data, and your interests outweigh those of the organization.
- Direct Marketing: If you object to your data being used for direct marketing purposes.
- Unlawful Collection or Use: If the organization collected or used your data unlawfully.
- Legal Obligation: If there is a legal obligation to erase your data.
- Data Collected from a Child: Even if you are now an adult, you have the right to have data collected from you as a child erased.
2. How to Request Data Deletion
To exercise your right to erasure, follow these steps:
- Contact the Organization: Inform the organization that you want specific personal data erased. You can contact any part of the organization verbally or in writing.
- Written Request: We recommend following up any verbal request in writing. Use the template below to help you exercise your right:
[Your full address] [Your phone number] [The date] [Name and address of the organization] [Reference number (if provided within the initial response)] Dear [Sir/Madam or name of the contact person], Right to Erasure [Your full name and address, along with any other relevant details] I wish to exercise my right of erasure under data protection law. Please erase the following personal data: [Specify the data you want erased.]
You can find guidance on your obligations under information rights legislation on the website of the Information Commissioner’s Office (www.ico.org.uk), along with information on their regulatory powers and the action they can take.
- Proof of Action: Keep a record of your request, including any responses from the organization. This will help if you need to challenge their response.
